PROCEEDINGS OF THE STURGIS CITY COUNCIL

 

The Common Council of the City of Sturgis met in regular session at 7:30 p.m. on Tuesday February 19, 2008 at the Sturgis Community Center. Present: Mayor Maury LaRue, Alderpersons Steve Anders, Roger Call, Mark Chaplin, Tom Ferguson, David Hersrud, Jamie McVay, Sherry Scudder, and Bernadette Usera and City Manager Dave Boone.  Absent: none.

 

Mayor LaRue led everyone present in the Pledge of Allegiance.

 

Mayor LaRue made the following announcements:

Ø      The Ag Banquet sponsored by the Sturgis Area Chamber of Commerce will be held on February 23, 2008 at the Community Center

Ø      A drop-off day care has been formed at the Community Center to allow parents to participate in activities at the center

Ø      A Presentation flag was given to the City of Sturgis by Matt Veal.  Mr. Veal had served in Afghanistan.  

 

Motion by Chaplin, seconded by Anders and carried with all members voting yes to approve the agenda.

 

Motion by Chaplin, seconded by Call and carried with all members voting yes to approve the minutes from February 4, 2008 regular meeting with the correction of substituting Anders for Scudder in the motion to approve the minutes and also to approve the minutes from the special meeting held on February 11, 2008.

City Manager Report:

·         Boone will be doing a guest editorial in the newspaper

·         Boone is looking at re-financing the sales tax bonds because of the lower interest rates.  He will also be looking at some options of purchasing some new debt.

·         They are working on the sign ordinance and hope to have a public meeting in the next couple of weeks

·         SEDC attended the Shot Show and there are prospects of bring new business into the community

 

Motion by Hersrud, seconded by Chaplin, and carried with all members voting yes to set a public hearing date of March 17, 2008 for a zoning variance request from Steve Derouchey for Lot 3, Block C Glovers 1st Addition to allow for less than required set backs.

 

Motion by Ferguson, seconded by Scudder, and carried with Anders, Chaplin, Ferguson, Hersrud, McVay, Scudder and Usera voting yes and Call abstaining to transfer the wine license for Olde Worlde Café & Bookery from 1543 Lazelle Street to 923 Junction Avenue.

PARKING AND STOPPING

 

BE IT ORDAINED by the Common Council of the City of Sturgis, Meade County, South Dakota, that Title 16 Chapter 16.05 PARKING AND STOPPING be replaced in its entirety with the following:

16.05.01:  VEHICLES SHALL STOP AT CERTAIN THROUGH HIGHWAYS OR

                  STREETS

 

The City Council shall by authorizing the placement of octagonal shaped "Stop " signs, determine at what intersections vehicles shall come to a complete stop.  No person shall fail to obey said signs by failing to bring the vehicle to a complete stop.

 

16.05.02:  VEHICLES SHALL YIELD AT CERTAIN THROUGH HIGHWAYS OR

                  STREETS

 

The City Council shall, by authorizing the placement of triangular shaped "Yield Right of Way" signs determine at what intersections certain vehicles shall have a preferential right of way.  The driver of a vehicle approaching a yield sign shall in obedience to such sign slow down to a speed reasonable for the existing conditions, or shall stop, if necessary, and shall yield the right of way to any pedestrian legally crossing the roadway on which he is driving, and to any vehicle in the intersection or approaching on another highway so closely as to constitute an immediate hazard.  Said driver having so yielded may proceed and the drivers of all other vehicles approaching the intersection shall yield to the vehicle so proceeding.

 

16.05.03:  PARKING OR STOPPING ON STREETS OR HIGHWAYS

 

Any vehicle parked or stopped in the business district must be diagonally parked in the lanes designated for parking by appropriate signs on the pavement or curb, except in area designated for parallel parking or in areas which the Police Department may designate under authority and direction of the City Council by proper signs as "No Parking" and wherever said Police Department has so designated "No Parking" it shall be unlawful for any person to fail to comply therewith.

 

On all other highways or streets in the City not otherwise designated by the foregoing subsections or succeeding Sections, or by the Police Department as directed by the City Council, all vehicles shall be parked parallel with the curb.

 

A.                 No person shall park or leave standing any truck, except pick-up trucks, on Main Street between its intersection with Middle street and its intersection with Sixth Street and no person shall park a truck on any street or alley in the City in such a manners to impede traffic or so as to be dangerous or likely to be dangerous to other persons traveling on such street or alley.

 

B.                 No person shall park or leave standing any vehicle upon Main Street from the intersection of Middle Street to the Main Street intersection with Sixth Street and to include all side streets one block either side of Main Street to include both sides of Sherman Street from Fourth Street to Junction Avenue, and Lazelle Street on the north, and also to include First Street, Third Street, and Fourth Street north of Lazelle Street to Bear Butte Creek, Middle Street from Lazelle Street to Sherman Street, between the hours of 2:00 a.m. and 6:00 a.m. Friday, or during anytime, when in the Director of Public Works opinion, such streets must be cleared of snow for the safe and orderly flow of traffic, or during such times as the City Council, by resolution, shall deem it necessary to prohibit parking for the safety, health and welfare of the general public.

 

C.                 No person shall park or leave standing any vehicle upon Junction Avenue from its intersection with Main Street, South to Sturgis City Limits. 

 

D.                 No person shall park or leave standing any vehicle upon Cleveland Street from its intersection with Ninth Street, West to the Interstate Right-of-Way.

 

E.                  No person shall park or leave standing any vehicle upon Moose Drive from its intersection with Dolan Creek Road to Highway 14A.

 

16.05.04:  DIAGONAL PARKING REQUIREMENTS

 

Any vehicle parked diagonally shall be drawn up to the curb, gutter or sidewalk on the right-hand side of the street at an angle of 45 degrees with the curb line thereof, such vehicle to be parked within six (6) inches of the curb, gutter or sidewalk on and along said street upon which such vehicle is parked, and no vehicle shall nearer than one foot to any other vehicle.

 

16.05.05:  PARALLEL PARKING REQUIREMENTS

 

Any vehicle parked parallel shall be drawn up parallel to the curb, gutter or sidewalk on the right-hand side of the street, the hub of both wheels on the right-hand side of the vehicle to be within one foot of the curb, gutter or sidewalk on and along the street upon which such vehicles are parked, and no vehicle shall be parked nearer than three feet of the front or rear of any other vehicle.

 

16.05.06:  STOP:  ALLEY OR PRIVATE DRIVEWAY

 

Any driver of a vehicle emerging from an alley, driveway or building shall stop such vehicle immediately prior to driving onto the sidewalk area extending across any alleyway.

 

16.05.07:  PARKING AND STOPPING PROHIBITED IN CERTAIN PLACES

 

No person operating a vehicle shall stop, stand or park such vehicle on any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal:

 

A.                 Within an intersection;

 

B.                 On a crosswalk;

 

C.                 In front of a private driveway;

 

D.                 On a sidewalk;

 

E.                  Alongside or opposite any street excavation or obstruction when such stopping, standing or parking would obstruct traffic;

 

F.                  Within 15 feet of the driveway entrance to any fire station;

 

G.                 Within 15 feet of a fire hydrant;

 

H.                 Within 15 feet of the point of intersection of curb lines;

 

I.                    At a designated "loading or Passenger Zone";

 

J.                   At a designated taxicab stand or bus stand;

 

K.                 Any "No Parking" zone which may be designated by signs or by a curb which is painted with a solid yellow stripe; or

 

L.                  In a public alley within the City limits, except that trucks and other vehicles may stop in such alleys for the purpose of loading or unloading merchandise or materials.  The vehicles loading and/or unloading in the alleys on either side of Main Street from Middle Street to Fourth Street may stop to load or unload only while the vehicle is attended;

 

M.                On the roadway side of any other vehicle stopped or parked at the edge or curb of a street except temporarily engaged in the loading or unloading of passengers or materials;

 

N.                 On the highways, streets and alleys of the City in such a manner as to obstruct vehicular or pedestrian traffic;

 

O.                 It shall be unlawful for any person to park or leave standing any vehicle in a stall or a space designated for physically handicapped persons, if such stall or space is posted or marked in a prescribed way, unless the vehicle displays distinguishing license plates or place cards issued for handicapped persons, including disable veterans.  A person convicted of violating this sub-section shall be punished by a mandatory fine of not less than $100.00.  The Police Department of the City is hereby authorized to remove any vehicle at the expense of the owner of the vehicle from a stall or a space designated for physically handicapped persons, if the vehicle is parked in violation of the above provisions.

 

16.05.08:  PARKING:  SNOW REMOVAL

 

In order that the Street Department may efficiently clean the streets and highways in the City, the Police Department or the person in charge of the cleaning of the streets is hereby authorized to place signs in any block or blocks within said City stating that snow removal will be made at a specified time in the near future in which case it shall be unlawful to park any motor vehicle upon any of the said streets or highways upon which said signs have been placed during the specified time.  Such signs shall be placed at the end of each of said blocks to be cleaned.

 

Any vehicle parked in violation of any of the provisions of this Section may be removed by the Police Department or the Street Department and the owner thereof, in addition to the other penalties prescribed for the violation of this Section shall be required to pay the cost of towing and removal of said vehicle.

                         

16.05.09:  ACCUMULATION OF PERSONAL PROPERTY OR JUNK ON PUBLIC

                  PROPERTY PROHIBITED 

 

No person shall store, deposit, maintain or permit to be maintained or to accumulate upon any public right away any personal property including but not limited to the following:

 

A.                 Garbage, refuse, waste or rubbish;

 

B.                 Any vehicle that is abandoned, wrecked, dismantled or inoperative including any vehicle with flat tires, missing wheels, et cetera;

 

C.                 Any vehicle which is non-licensed or because of body damage, or operating apparatus, including tires and wheels, is in such a condition to render the start, legal operation, or use of said vehicle impossible; 

 

D.                 Any dead animal remaining on any public property for a period of more than twenty-four (24) hours;

 

16.05.10:  FIRES ON PUBLIC PROPERTY PROHIBITED

 

No person shall ignite any bonfire or campfire on public property;

 

16.05.11:  STORAGE ON PUBLIC PROPERTY PROHIBITED

 

No person shall, unless specifically authorized by the Sturgis Police Department, store or permit to be stored any trailer, recreational vehicle, implement, vehicle or other personal property on any public right-of-way.

 

For purposes of this Chapter, the term “store” shall include the following:

 

A.                 Leaving any car, pick up, motorcycle, camper, or recreational vehicle in any public right of way for more than five (5) consecutive days;

 

B.                 Leaving any farm tractor, implement, trailer, truck or truck tractor in any public right of way for more than twenty four (24) hours; or

 

C.                 During the period of July 20th  through August 15th leaving any recreational vehicle or camper in any public right of way for more than twenty four (24) hours.

 

Any trailer, recreational vehicle, implement, vehicle or other personal property being stored in violation of this Section shall be immediately removed from the right of way and may not be continued to be stored by moving said property to another location in any public right of way. 

 

16.05.12:  POLICE DEPARTMENT GRANTED CERTAIN AUTHORITY

 

The Sturgis Police Department shall have the power to authorize the storage of any vehicle or trailer in the public right a way upon request of an owner in the event said owner proves to the Police Department that the storage is necessary for a specific, temporary period of time at a certain location and that the vehicle or trailer is being used in connection with a construction, repair, or clean up project, or another event deemed appropriate by the Police Department and that said project is associated with real property adjacent to or closely located to the area of the public right away where the vehicle or trailer will be temporarily stored.  

 

16.05.13:  REMOVAL OF PROHIBITED CARS AND OTHER PERSONAL PROPERTY

 

Any vehicle or trailer located upon public property in violation of this Chapter or any traffic ordinance of the City may be summarily removed by the Police Department.  The owner of the removed vehicle, in addition to any fines and penalties which may be imposed for such violation, shall pay the charges for towing and storage of the removed vehicle.

 

Any personal property located on any public property in violation of this Chapter may be summarily removed by the Police Department.  The owner or person responsible for the violation, in addition to any fines and penalties which may be imposed for such violation, shall pay any costs incurred for the removal of the personal property. 

 

16.05.14:  VIOLATION FEES

 

In addition to the cost of removal and/or storage and assessment of any charges related thereto, any person who violates this chapter, except in the event where the violation involves parking a vehicle in a stall or space designated for physically handicapped persons, shall within 72 hours from the time when the notice of violation was attached to the vehicle, pay to the Sturgis Police Department the sum of $10.00.  If any person fails to pay the sum within 72 hours, he or she shall pay to the Sturgis Police Department the sum of $20.00.

 

Any person who parks a vehicle in a stall or space designated for physically handicapped persons as prohibited by the Chapter, shall within 72 hours from the time when the notice of violation was attached to the vehicle, pay to the Sturgis Police Department the sum of $100.00.  If any person fails to pay the sum within 72 hours, he or she shall pay to the Sturgis Police Department the sum of $110.00.

 

Any sums of money collected by the Sturgis Police Department under the provisions of this Chapter shall be deposited with the Finance Office.

 

16.05.15:  REVIEW BY PUBLIC SAFETY COMMITTEE

 

Any person having received a notice of violation from the Police Department made under this Chapter shall be entitled to have said decision/action reviewed by the Public Safety Committee.  The process shall be as follows:

 

A.                 An Aggrieved person shall request a review with the Police Department by filling out a written request form to be provided by the Police Department.

 

B.                 Upon completion of said form, the Police Department shall place the review upon the agenda for the next Public Safety Committee meeting. 

 

C.                 The Police Department shall provide written notice to the person requesting the review specifying the time, date and location of the meeting.

 

D.                 The Safety Committee may notify the aggrieved person of its decision following the meeting; however, the Committee shall issue a written decision to the person within twenty (20) days of the meeting.

 

Nothing in this section shall be construed to deprive any person of his or her constitutional right to a hearing or trial as to any violation charged.

 

16.05.16:  FAILURE TO PAY ENFORCED BY COURT APPEARANCE

 

Upon failure of any person to pay any violation fee or fine within the time periods indicated the City may request a summons from the magistrate court requiring said person to appear in court to answer for the violation.

 

16.05.17:  HANDICAPPED PARKING SPACES PROVIDED

 

The City Council may, by resolution, designate certain parking spaces within the regulated parking district established herein, as parking for the handicapped only.  These spaces shall be clearly designated by posting of signs designating them as handicapped parking spaces only.  Only a vehicle which is operated by a disabled person, or a vehicle in which a disabled person is riding, and which vehicle bears a sticker issued by the State of South Dakota, certifying that the owner/operator of this vehicle is a disabled person, shall be allowed to park in these handicapped designated parking spaces.  The fact that the vehicle bears a sticker issued by the State of South Dakota certifying that the owner/operator of the vehicle is a disabled person, shall not exempt the person operating the vehicle from complying with the parking time limit restrictions provided for in this Chapter.

Motion by Hersrud, seconded by Ferguson, and carried with Anders, Chaplin, Ferguson, Hersrud, McVay, Scudder and Usera voting yes and Call abstaining to set a public hearing date of March 3, 2008 for MAJR, LLC dba Sturgis Coffee Company for a Restaurant Malt Beverage License and a Wine License for 2275 Lazelle Street.

 

Motion by Scudder, seconded by Chaplin and carried with all members voting yes to approve the request from the Meade County Republican Women to sell 50/50 raffle tickets with drawing to be held March 29, 2008.

 

Motion by Chaplin, seconded by Anders and carried with all members voting yes to approve the request from TOPS Chapter 105 to sell raffle tickets for a oil painting  with the drawing to be held March 27, 2008.

 

At this time, Pepper Massey, Rally Director gave a presentation on reviving the Half Mile Race Event.  The City would provide $10,000 in matching funds for the purse and offer support through other departments with track prep, event facilities, and promotion with the in-kind cost of approximately $17,000.  Massey believes that this can generate revenue by drawing crowds to Sturgis for a wholesome event for the entire family; she would recommend working with the Gypsies on this event.  Motion by Hersrud, seconded by Scudder, with all members voting yes, to approve the City departments supporting this event and the expenditures needed to allow this Half-mile race event happen.

 

Motion by Chaplin, seconded by Anders, and carried with all members voting yes to extend the financial annual report due date from March 3, 2008 to April 7, 2008.

 

 

Chaplin introduced the following written resolution and moved its adoption:

 

 

 

 

RESOLUTION 2008-06

 

RESOLUTION AUTHORIZING CITY MANAGER, DAVE BOONE TO EXECUTE A CONTRACT AGREEMENT BETWEEN THE CITY OF STURGIS AND MEDICA INSURANCE COMPANY FOR HEALTH INSURANCE

 

            WHEREAS the City of Sturgis provides health insurance coverage as a benefit to its employees;

 

            WHEREAS the City’s current policy of insurance came up for termination or renewal;

 

            WHEREAS the City reviewed and analyzed several policy options and determined it to be in the best interest of the City to enter into an agreement for coverage with Medica Insurance Company; and

 

            WHEREAS the parties have agreed to the terms and conditions of the contract for said services,

 

            NOW THEREFORE be it resolved that Dave Boone, City Manager of the City of Sturgis, is hereby authorized to execute on behalf of the City of Sturgis the Agreement.

Scudder seconded the motion for the adoption of the foregoing resolution.  All those present voted in favor of and the resolution was declared passed & adopted.

 

Motion by Chaplin, seconded by McVay and carried with all members voting yes to approve the following write-off amounts in each fund: Water-$1,766.82, Sewer - $2,338.23, sanitation – $946.91.

 

Chaplin introduced the following written resolution and moved its adoption:

 

RESOLUTION 2008-07

RESOLUTION AUTHORIZING CITY MANAGER, DAVE BOONE TO EXECUTE A UTILITY EXTENSION AGREEMENT BETWEEN THE CITY OF STURGIS AND MERLIN AND GWEN EHLERS

 

            WHEREAS the Ehlers desire to reroute their City sewer service to their property located at 121 David Drive;

 

            WHEREAS the proposed sewer service line may benefit other property owners located in the area;

 

            WHEREAS the City has previously by Resolution adopted a Policy For the Extension of Sewer Mains which provides for the collection of connection fees from benefiting property owners and reimbursement to the property owner who incurred the cost.

 

            WHEREAS the parties have agreed to the terms and conditions of the Utility Extension Agreement.

 

            NOW THEREFORE be it resolved that Dave Boone, City Manager of the City of Sturgis, is hereby authorized to execute on behalf of the City of Sturgis the Agreement.

Ferguson seconded the motion for the adoption of the foregoing resolution.  All those present voted in favor of and the resolution was declared passed & adopted.

 

Motion by Chaplin, seconded by Ferguson and carried with all members voting yes to approve the following wage increase: Shannon Heikes: $7.00 to $7.25 an hour – Community Center and Codi Jones – experience works volunteer – Community Center.

           

ANY OTHER BUSINESS:

There will be a Legislative cracker barrel at the Community Center on February 23, 2008.

 

Motion by Chaplin, seconded by Usera and carried with all members voting yes to go into executive session for personnel at 8:21 pm.

 

Motion by Call, seconded by McVay and carried with all members voting yes to return to regular session at 8:40 pm.

 

Motion by Chaplin, seconded by Anders and carried with all members voting yes to increase  Finance Officer Fay Buenos salary 3% on March 1, 2008.

 

Motion by Usera, seconded by Scudder, and carried with all members voting yes to adjourn the meeting at 8:45 p.m.
