PROCEEDINGS OF THE STURGIS CITY COUNCIL

 

The Common Council of the City of Sturgis met in regular session at 7:30 p.m. on Monday March 17, 2008 at the Sturgis Community Center. Present: Mayor Maury LaRue, Alderpersons Steve Anders,  Mark Chaplin, Tom Ferguson, David Hersrud, Jamie McVay, Sherry Scudder,  Bernadette Usera and City Manager Dave Boone.  Absent: Roger Call.

 

Mayor LaRue led everyone present in the Pledge of Allegiance.

 

Mayor LaRue made the following announcements:

Motion by Anders, seconded by Chaplin and carried with all members voting yes to approve the agenda.

This was the designated time for committee reports:

v      Public Safety— update on Bicycle Rally that will be held on July 12 – discussion on outdoors concerts that Loud American Roadhouse will be having this Summer 

v      Public Works—Nothing – next meeting will be the first Monday in April          

v      Community Center— the roof replacement is going well

v      Liquor—nothing to report

v      Legal and Finance—nothing to report  

v      Rally— Discussion on the V-Twin show, Daytona and participation in the Indy

v      Park Board—nothing to report

v      Planning Commission—nothing to report

v      Library Board—Story telling on Thursday with the Spring Equinox being the subject.  Pots for Spring Gala will be available next week.  Discussion is being held with Meade 46-1 and the proposal  of having a Library at Bear Butte School.  More information in April  

v      Airport Board—nothing

City Manager Report:

·         There is increasing interest in economic development at sites on Exit 31 & 32

·         Refinancing of the sales tax bond and loans can take place after April 2, so will be watching the rates closely

·          There will be a public meeting held to discuss the proposed Sign ordinance on March 31 at 6:30 PM at the Community Center.  A copy of the ordinance will be provided for anyone to look at.

·         The purchasing policy is in full swing and is going well

·         There will be a new procedure implemented for Planning amd Zoning.  Prior to any decision being made by the Board a recommendation with all the information and details based on the Code will be given to them.

 

This was the time set upon for a public hearing for Dean McNenny for a change of zoning amendment to highway service for 2103 Junction Ave. 

 

Councilperson Scudder read a letter from Shelley Montanio, who opposes the zoning change.  Ms. Montanio resides at 1002 McNenny Drive.

 

Pat Baldwin, Realtor for Century 21, gave his reasons for allowing the change:  the property is located next to the railroad track and a busy street and traffic should not increase that much if changed to Highway Service.  Mr. Baldwin does not feel that changing this property zoning to highway service would change the integrity of Junction.   He felt that the Hospital would not be concerned about changing the zoning.  

 

Roger Schieman – was in favor of changing the zoning on the property so a business could locate there.

 

Walt Saubers – was against the rezoning of this property.  He felt that spot zoning brings on more rezoning of Junction and that this would bring rally businesses that would encroach on residential areas.

 

Charlie Blotsky who lives on McNenny Drive was against the rezoning.  He felt that the water channel is the cut off point for commercial and residential.  He felt that it will continue down Junction if this rezoning happens.    

 

At this time Hersurd made a motion to deny the change in the amendment and Chaplin seconded it and carried with Anders, Chaplin, Ferguson, Hersrud, LaRue, Scudder and Usera voting yes and McVay voting nay.

 

McVay introduced the following written resolution and moved its adoption:

RESOLUTION 2008-10

RESOLUTION APPROVING PLAT

 

            WHEREAS, the statutes of the State of South Dakota require that plats of property within the City of Sturgis be submitted to the governing body for approval before the same are recorded in the Office of the Register of Deeds; and

            WHEREAS, Palisades Subdivision,, has presented to the Common Council of the City of Sturgis a plat of the following described real property:

           

Lots 1 thru 5, Block 2, of Palisades Subdivision, formerly a portion of Lots 2H, 3H2 and 4H of Hurley Subdivision, located in the N1/2NW1/4, Section 16, T5N, R5E, BHM, City of Sturgis, Meade County, South Dakota. 

 

WHEREAS, said plat meets the requirements of the statutes in all things, now

therefore,

            BE IT RESOLVED by the Common Council of the City of Sturgis, South Dakota, that the within and foregoing plat is hereby approved.

Motion by Chaplin, seconded by Scudder and carried with all members voting yes to approve seconded reading of Ordinance 2008-4”Supplemental Ordinance for the Library”

 

Ordinance No. 2008-04

AN ORDINANCE AMENDING ORDINANCE NO. 2007-33 ANNUAL APPROPRIATIONS FOR THE YEAR 2008 OF THE CITY OF STURGIS, MEADE COUNTY, SOUTH DAKOTA

 

            BE IT ORDAINED by the Common Council of the City of Sturgis, Meade County, South Dakota, that ordinance 2007-33 be amended so that the following amounts are hereby appropriated to meet the obligation of the municipality for the year 2008.

 

            General Fund - Library

Motion by Ferguson, seconded by Usera and carried with all members voting yes to approve the street closure of Third Street from Main to alley next to the Loud American Roadhouse on June 14th, June 28th and July 18th.  This will include selling and serving alcohol at this location.

 

Motion by Ferguson, seconded by Scudder and carried with all members voting yes to approve a special events license for Loud American Roadhouse to serve at the Sturgis Auditorium on March 29, 2008 for the Meade County Republican banquet.

 

Motion by Chaplin, seconded by Ferguson and carried with all members voting yes to approve a special events license for the Oasis Bar to serve at the Sturgis Auditorium on May 3, 2008 for a wedding.

 

Motion by Chaplin, seconded by Anders and carried with all members voting yes to approve a special events license for the Oasis Bar to serve at the Sturgis Auditorium on August 23, 2008 for a wedding.

 

Motion by Usera, seconded by Chaplin and carried with all members voting yes to approve the request to sell raffle tickets by the Meade County Democrats, with the following items being raffled gift certificates, quilts and silent auction items, drawing to be held on August 23, 2008.

 

Chaplin introduced the following written resolution and moved its adoption:                       

 

Resolution 2008-11

Bridge Reinspection Program Resolution

For Use with SDDOT Retainer Contracts

 

WHEREAS, Title 23, Section 151, United States code and Title 23, Part 650, Subpart C, Code of Federal Regulations, requires initial inspection of all bridges and reinspection at intervals not to exceed two years with the exception of reinforced concrete box culverts that meet specific criteria.  These culverts are reinspected at intervals not to exceed four year.

 

THEREFORE, the City of Sturgis is desirous of participating in the Bridge Inspection Program using Bridge Replacement funds.

 

The City requests SDDOT to hire Brosz Engineering (Consulting Engineers) for the inspection work.  SDDOT will secure Federal approvals, make payments to the Consulting Engineer for inspection services rendered, and bill the City for 20% of the cost.  The City will be responsible for the required 20% matching funds.

 

There are a total of 6 bridges in the City of Sturgis that require inspection.

McVay introduced the following written resolution and moved it adoption:

 

RESOLUTION 2008-12

RESOLUTION AUTHORIZING THE MAYOR, MAURY LARUE TO EXECUTE A SEWER LINE EXTENSION AGREEMENT BETWEEN THE CITY OF STURGIS AND CECIL D. CLARK AND JOHN D. LAWSON, MOUNT RODNEY RV PARK

 

            WITNESSETH that the City of Sturgis upon the request of Mount Rodney RV Park, LLC, and Cecil D. Clark did expand the city sewer system from approximately the Deadman Creek area up the north side of Bear Butte Creek and the City park portion being extended from Woodland Trailer Court along the southside of Mount Rodney RV Park.  The portion of the woodland sewer line that abuts Mount Rodney RV Park was in the sum of $113,692.70 which is approximately $77. per lineal foot.

           

WHEREAS the cost of the sewer line from the east end of the Woodland Trailer Court to Mount Rodney RV Park eastline was in the total sum of $71,400.  It was agreed between the parties that the City would pay for $41,400 of said cost and Mount Rodney would pay $30,000 of said cost for a total cost of $143,692.70; and

 

            WHEREAS Mount Rodney RV Park waives the right to any further sewer tap fees, the City agrees to reduce the amount due to $125,000; and

 

            WHEREAS in consideration of this agreement the total sewer cost upon completion for the Mount Rodney RV Park shall be $125,000; and

 

            WHEREAS the parties have agreed to the terms and conditions of the Sewer Line  Extension Agreement.

 

            NOW THEREFORE be it resolved that Maury LaRue, Mayor of the City of Sturgis, is hereby authorized to execute on behalf of the City of Sturgis the Agreement.

Scudder seconded the motion for the adoption of the foregoing resolution.  All those present voted in favor of and the resolution was declared passed and adopted.

 

Motion by Chaplin, seconded by Anders to approve the hiring of Lyle Chase at $8.50 an hour for the Parks Department, this is a seasonal position.

 

ANY OTHER ITEMS DISCUSSED:

Council member Scudder reminded everyone that “Women with Melody” will be at the Sturgis Community Center on April 6, 2008

 

Motion by Anders, seconded by Usera and carried with all members voting yes to go into executive session for legal advice, contracts and personnel at 8:06 pm.

 

Motion by Usera, seconded by Anders and carried with all members voting yes to return to regular session at 9:10 pm.
