PROCEEDINGS OF THE STURGIS CITY COUNCIL
The Common Council of the City of Sturgis met in regular session at 7:30 p.m. on Monday April 7, 2008 at the Sturgis Community Center. Present: Mayor Maury LaRue, Alderpersons Steve Anders, Roger Call, Tom Ferguson, David Hersrud, Jamie McVay, Sherry Scudder, Bernadette Usera and City Manager Dave Boone. Absent: Mark Chaplin
Mayor LaRue led everyone present in the Pledge of Allegiance.
Mayor LaRue made the following announcements:
Ø National Library Week will be held April 13-19, 2008
Ø Clean up week will be held May 5-10, 2008
Ø Mayor LaRue thanked Pizza Hut for their donation of food to the Fire Department after the last fire call
Ø Bill Cissell and Jason Gross were recognized for their contributions to the newspaper
Motion by Anders, seconded by Call and carried with all members voting yes to approve the agenda with the correction of May 14, 2008 for canvass/workshop to April 14, 2008 for canvass/workshop.
Motion by Anders, seconded by Ferguson and carried with all members voting yes to approve the minutes from March 17, 2008 and the minutes from the board of equalization.

City Manager Report:
· Budget control report: The total budget is at 18% and the General Fund at 23%
· A Community Development focus group is being formed with the facilitator being Kristi Wagner. This will help form a vision for the community and set strategic goals to shape the future of Sturgis
· SBA and the Jaycees are working on a revision of the sign ordinance
· A work study session will be April 14th at 6:00 p.m. to help conform to Title 7 with the reorganization of boards and commissions due to a City manager form of government
· An aftermarket parts for motorcycles business may relocate to Sturgis
· Sales Tax bonds have not been issued yet, I am watching the market
· A presentation will be given to the Scientist from the Homestake Lab on April 24, 2008 on what Sturgis has to offer.
· With a donation for materials from Don Feist the Sturgis sign will once again be on the north hill overlooking the City.

Call introduced the following written resolution and moved its adoption:
RESOLUTION 2008-13
RESOLUTION APPROVING PLAT
WHEREAS, the statutes of the State of South Dakota require that plats of property within the City of Sturgis be submitted to the governing body for approval before the same are recorded in the Office of the Register of Deeds; and
WHEREAS, Richard Schmid, Bryce A. Flint, Carmen K. Flint and Paula Barth, members of Dudley, LLC, have presented to the Common Council of the City of Sturgis a plat of the following described real property:
Tract 1 and Tract 2 of Dudley Tracts, a subdivision of the east 100’ of Lots 9 and 10 and all of lots 11 and 12 in Block 1 of Conner’s Extension, City of Sturgis, Meade County, South Dakota.
WHEREAS, said plat meets the requirements of the statutes in all things, now
therefore,
BE IT RESOLVED by the Common Council of the City of Sturgis, South Dakota, that the within and foregoing plat is hereby approved.

Scudder seconded the motion for the adoption of the foregoing resolution. All those present voted in favor of and the resolution was declared passed and adopted.
Motion by Anders, seconded by Ferguson and carried with all members voting yes to approve setting May 5, 2008 for a public hearing for the Hospital property Block 6, lots 1-12 & 31 & 32 of McMillians Southern Addition for a rezone from R-2 to R1/Office Commercial.
Motion by Call, seconded by McVay and carried with all members voting yes to approve setting May 5, 2008 for a public hearing for Loren Bruce owner of 2204 Hurley Drive for a Zoning Variance application in regards to a rear yard set back.
Motion by McVay, seconded by Scudder and carried with all members voting yes to approve setting May 5, 2008 for a public hearing for Rod Simmons owner of 1221 Spruce Street for a Zoning Variance application in regards to a side yard set back.
Motion by McVay, seconded by Scudder and carried with Anders, Ferguson, Hersrud, LaRue, McVay, Scudder, and Usera voting yes and Call abstained to set a public hearing date of April 21, 2008 for a transfer of a malt beverage license from Ace of Diamonds to William Whelchel (Willie Nillie, Inc.) and a new wine license for William Whelchel (Willie Nillie Inc.)
Call introduced the following written resolution and moved its adoption:

The Common Council of the City of Sturgis met at its regularly scheduled session on Monday, April 7, 2008 at 7:30 p.m. at the Sturgis Community Center.
Present: Mayor Maury LaRue and:
Steve Anders, Roger Call, Tom Ferguson, David Hersrud, Jamie McVay, Sherry Scudder, and Bernadette Usera
Absent:
Mark Chaplin
Motion by Call and seconded by Ferguson , and carried with all members voting yes except Scudder abstained, to authorize Mayor LaRue to sign a letter of support to South Dakota Housing Development Authority for the construction of Heritage Acres IV, consisting of 32 apartment units to be constructed by Heritage Acres IV, with occupancy targeted to the elderly.
Ferguson seconded the motion for the adoption of the foregoing resolution. All those present, except for Scudder who abstained, voted in favor of and the resolution was declared passed and adopted.
Hersrud introduced the following written resolution and moved its adoption:
RESOLUTION 2008 - 15
A RESOLUTION APPROVING A CONTRACT WITH THE STURGIS CHAMBER OF COMMERCE AND AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT ON BEHALF OF THE CITY OF STURGIS
WHEREAS the City of Sturgis desires to enter into a Service Agreement with the Sturgis Chamber of Commerce; and
WHEREAS an agreement needs to be entered into between the parties whereby the Sturgis Chamber of Commerce shall provide a retail, tourism and visitor business development program to provide for economic growth through the retention, expansion, and recruitment of retail, tourism and visitor businesses; and
WHEREAS the City of Sturgis desires to enter into such agreement, a copy of which is attached hereto.
NOW THEREFORE Mayor Maury LaRue is hereby authorized to execute said Agreement for the above intended purposes.

Hersrud introduced the following written resolution and moved its adoption:
RESOLUTION 2008 - 16
A RESOLUTION APPROVING A CONTRACT WITH THE STURGIS ECONOMIC DEVELOPMENT CORPORATION AND AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT ON BEHALF OF THE CITY OF STURGIS
WHEREAS the City of Sturgis desires to enter into a Service Agreement with the Sturgis Economic Development Corporation; and
WHEREAS an agreement needs to be entered into between the parties whereby the Sturgis Economic Development Corporation shall provide an economic development program to provide for economic growth through the retention, expansion, and recruitment of employment opportunities; and
WHEREAS the City of Sturgis desires to enter into such agreement, a copy of which is attached hereto.
NOW THEREFORE Mayor Maury LaRue is hereby authorized to execute said Agreement for the above intended purposes.

Anders seconded the motion for the adoption of the foregoing resolution. All those present voted in favor of and the resolution was declared passed and adopted.
Motion by Hersrud, seconded by Scudder and carried with Anders, Ferguson, Hersrud, LaRue, McVay, Scudder, and Usera voting yes and Call abstained to approve a special events license for Loud American Roadhouse to serve at the Sturgis Auditorium on April 12, 2008 for a wedding.
Motion by Call, seconded by Scudder and carried with all members voting yes to approve the request to sell raffle tickets by Legion Post 33 baseball for a flat screen TV; with the drawing to be held on June 26, 2008.
Motion by Call, seconded by Hersrud and carried with all members voting yes to table the request from NW Domestic Crisis Service to sell raffle tickets until further information is gathered.
Motion by McVay, seconded by Anders and carried with all members voting yes to accept the bid from Spearfish Fencing for $12,802 to install the fencing at the Pony Field. There were no other bids.
Motion by Scudder, seconded by Usera and carried with all members voting yes to change the legal paper back to Black Hills Press.
Motion by Call, seconded by Anders and carried with Anders, Ferguson, Hersrud, Scudder and Usera voting yes and LaRue and McVay voting nay that the money would be a loan from the Sanitation fund to the General Fund for the Community Center roof and should be paid back to the Sanitation Fund contingent on the Community Centers ability to pay.
Motion by Anders, seconded by Ferguson and carried with all members voting yes to approve the hiring of Amber Stansbury at $6.55 an hour for the Community Center – Custodial and the following wage increases for Parks –seasonal employees: Lyle Chase - $9.00, Lawrence Hertel - $8.25, Gene Lucas - $8.00, Albert Arsaga - $9.00.
ANY OTHER ITEMS DISCUSSED:
Motion by Hersrud, seconded by Ferguson and carried with all members voting yes to go into executive session for legal advice and contracts at 8:15 pm.
Motion by Ferguson, seconded by Call and carried with all members voting yes to return to regular session at 9:30 pm.
Motion by Anders, seconded by Hersrud, and carried with all members voting yes to recess and reconvene on April 14, 2008 at 6:00 p.m. at the Sturgis Community Center.
